The controller responsible for data processing on this website is:
proQtech GmbH
Borngartenstr. 10
63303 Dreieich
Germany
Phone: +49 (0) 6103-2093-50
Email: info@proqtech.com
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g., names, email addresses, etc.).
Unless a more specific storage period has been stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for erasure or revoke your consent to data processing, your data will be erased unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, erasure will take place once these reasons cease to apply.
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data pursuant to Art. 9(1) GDPR are processed. In the case of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to the access to information on your terminal device (e.g., via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent may be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data on the basis of Art. 6(1)(c) GDPR if it is required to fulfill a legal obligation. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the relevant legal bases in each individual case is provided in the following paragraphs of this privacy policy.
Among other things, we use tools from companies based in the USA. When these tools are active, your personal data may be transferred to the USA and processed there.
On July 10, 2023, the European Commission adopted an adequacy decision for companies certified under the EU-U.S. Data Privacy Framework (DPF). Data transfers to these companies are therefore permissible under Art. 45 GDPR. Where a provider is not certified, we base the transfer on the Standard Contractual Clauses of the European Commission (Art. 46 GDPR). Please note that U.S. authorities may, under certain conditions, access data stored on U.S. servers. We have no influence over these processing activities.
Many data processing operations are only possible with your express consent. You may revoke any consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work, or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent technically feasible.
Within the scope of the applicable statutory provisions, you have the right at any time to obtain information free of charge about your stored personal data, its origin and recipients, and the purpose of the data processing and, where applicable, a right to rectification or erasure of this data. You may contact us at any time regarding this and any other questions on the subject of personal data.
You have the right to request the restriction of the processing of your personal data. You may contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
If you have restricted the processing of your personal data, this data may – apart from its storage – only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a member state.
For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
We hereby object to the use of contact data published within the scope of the legal notice (Impressum) obligation for the purpose of sending advertising and information materials that have not been expressly requested. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam emails.
Our web pages use so-called "cookies." Cookies are small text files and do not cause any damage to your terminal device. They are stored on your terminal device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your terminal device until you delete them yourself or until they are automatically deleted by your web browser.
In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies are used to analyze user behavior or to display advertising.
Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested (e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent may be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.
Where cookies are used by third-party companies or for analytics purposes, we will inform you of this separately within this privacy policy and, if necessary, request your consent.
On your first visit, we use a consent banner to ask whether you agree to the categories "Statistics" (Google Analytics) and "Marketing" (Google Ads, Leadfeeder). These services are only loaded after you give your consent. We store your selection in your browser's local storage (localStorage), not in a cookie; this is strictly necessary to provide the function you have requested (Section 25(2) No. 2 TDDDG). You can change or revoke your consent at any time with effect for the future via the "Cookie Settings" link at the bottom of every page.
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
This data is not merged with other data sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be collected.
If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent.
In addition, we store the page on which you submitted the form and – if available – campaign parameters from the page address (e.g., utm_source), so that we can see how inquiries reach us.
To manage inquiries, we use a lead management system in which your details are stored on our behalf. The servers are located in the EU (Supabase, Frankfurt am Main; Vercel, EU). A data processing agreement pursuant to Art. 28 GDPR is in place with the provider. Before forwarding, we use Cloudflare Turnstile to check whether the inquiry comes from a human (see "Cloudflare Turnstile").
This data is processed on the basis of Art. 6(1)(b) GDPR if your inquiry is related to the performance of a contract or is required for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent may be revoked at any time.
The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your inquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
The same applies accordingly to the forms with which you request documents (e.g., company brochure or line card) on our website. We use the information requested there (name, company, email address, phone number) to provide you with the documents and to contact you – as indicated in the form.
If you contact us by email, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
The data you send us via contact requests will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
On our website, you have the option of scheduling appointments with us. We use the tool "Calendly" for booking appointments. The provider is Calendly LLC, 271 17th St NW, 10th Floor, Atlanta, Georgia 30363, USA (hereinafter "Calendly").
For the purpose of booking an appointment, you enter the requested data and your preferred date in the form provided for this purpose. The data entered is used for planning, conducting, and, if applicable, following up on the appointment. The appointment data is stored for us on the servers of Calendly, whose privacy policy you can view here: https://calendly.com/de/pages/privacy.
The data you enter will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies. Mandatory statutory provisions – in particular retention periods – remain unaffected.
The legal basis for data processing is Art. 6(1)(f) GDPR. The website operator has a legitimate interest in making appointments with prospective customers and customers as easy as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's terminal device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent may be revoked at any time.
Data transfers to the USA are based on the Standard Contractual Clauses of the European Commission. Details can be found here: https://calendly.com/pages/dpa.
This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables us to analyze the behavior of website visitors. In doing so, we receive various usage data, such as page views, time spent on the site, operating systems used, and the origin of users. In Google Analytics 4, IP addresses are not logged or stored. The information collected by Google may be transferred to Google servers in the USA.
This service is used exclusively on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent may be revoked at any time via the "Cookie Settings."
Data transfers to the USA are based on the EU-U.S. Data Privacy Framework and on the Standard Contractual Clauses of the European Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.
Further information on how Google Analytics handles user data can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.
We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.
We use Google Ads, an online advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. As part of Google Ads, we use conversion tracking: If you click on an ad placed by Google and then visit our website, Google and we can recognize that you clicked on the ad and were redirected to our website. Use takes place exclusively on the basis of your consent ("Marketing" category) pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent may be revoked at any time. We have concluded a data processing agreement (DPA) with the above-mentioned provider.
This website uses the analytics service Plausible Analytics. The provider is Plausible Insights OÜ, Västriku tn 2, 50403 Tartu, Estonia.
Plausible does not use cookies and does not store any personal data. To count unique visitors, a value is generated from the IP address and the browser identifier, which is encrypted daily with a new random value; the IP address itself is not stored. The data is processed on servers in the EU. We receive only aggregated statistics (e.g., page views, referring pages, device type, country).
Use takes place on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in a data-minimizing statistical analysis of our website. Details: https://plausible.io/data-policy.
For our corporate film, we use the video service Bunny Stream. The provider is BunnyWay d.o.o., Cesta komandanta Staneta 4A, 1215 Medvode, Slovenia.
The video player is only loaded when you start the film. A connection to Bunny's servers is then established; your IP address and technical information (e.g., browser type) required for delivering the video are transmitted.
Use takes place on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in an appealing presentation of our offering. Details: https://bunny.net/privacy.
To protect our forms against spam and automated access (bots), we use Cloudflare Turnstile. The provider is Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA.
Turnstile is only loaded once you start filling in one of our forms (contact form, document requests). A connection to Cloudflare's servers is then established. Based on technical characteristics – in particular your IP address, information about your browser and operating system, and signals about your interaction with the page – Turnstile checks whether the input comes from a human. This usually happens unnoticed; only in cases of doubt does a short check appear. When you submit the form, our server confirms the result of the check with Cloudflare. The content of your form entries is not transmitted to Cloudflare.
Use takes place on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in protecting our website and the inquiries addressed to us against abusive automated use and spam. Insofar as information is stored on or read from your device, this is strictly necessary for sending the form at your request (Section 25(2) No. 2 TDDDG).
Data transfers to the USA are based on the standard contractual clauses of the EU Commission and on the EU-US Data Privacy Framework (DPF), under which Cloudflare is certified. Details: https://www.cloudflare.com/turnstile-privacy-policy/ and https://www.cloudflare.com/privacypolicy/.
We offer you the opportunity to apply to us (e.g., by email, by post, or via an online application form). Below, we inform you about the scope, purpose, and use of your personal data collected as part of the application process. We assure you that the collection, processing, and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.
If you send us an application, we process the associated personal data (e.g., contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Art. 6(1)(b) GDPR (initiation of an employment relationship) and – if you have given consent – Art. 6(1)(a) GDPR. Consent may be revoked at any time. Within our company, your personal data will only be passed on to persons involved in processing your application.
If the application is successful, the data you have submitted will be stored in our data processing systems on the basis of Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.
If we are unable to offer you a position, you decline a job offer, or you withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular evidentiary purposes in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place once the purpose for further retention no longer applies.
Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations preclude deletion.
If we do not offer you a position, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and information from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.
Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6(1)(a) GDPR). Giving consent is voluntary and has no bearing on the ongoing application process. The data subject may revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool unless there are statutory reasons for retention.
The data in the applicant pool will be irrevocably deleted no later than two years after consent has been given.
